This work make a comparative analyse between two methods of management archaeological heritage in Portugal and Brazil. In Portugla the Highway A23 and in Brazil Highway Carvalho Pinto (SP-070). The Planning and Management Archaeological Heritage, appears in the 60´s of XX century with Institutions like ICOMOS in Australia or the creation of Lausanne Charter. The idea of heritage appears in the Modern Époque with the collecting of objects, and the first laws even during the colonial period. One of the most important moments of the definitions of ambient guidelines it is the Diretiva 85/337/CEE, with principals of polluter-payer and the preventive actions of ambient impact. 
Both case studies have demonstrate that legislations have failures in some points, in Brazil, where the research bound the adventure, without real incentives for the development research. In Portugal where the research doesn´t bound the adventure brings difficulty of the execution of good projects, having to resort to the cooperation of institutions and volunteer work of the development of knowledge. But in both cases has been possible to achieve good results when the archaeology team works together with the governmental institution of heritage and with the construction company, respecting the constraints of each one. It is important that the archaeology team have conscience about the necessity of the dead line of the works to not impair the normal evolution of the work, or the conscience of the construction company about the necessity in preservation of archaeological heritage and make same preventive studies, and finally the governmental institution of heritage carry out his role of monitoring and intervene in the right moment, so creating efficient solutions for the problems.
